Handling Fee Emergency Regulations

Governor Schwarzenegger signed changes to the California Beverage Container Recycling and Litter Reduction Act into law on September 30, 2006. Assembly Bill 3056 (Chapter 907, Statutes of 2006) amended, among other things, Section 14585 which changed the process for determining how handling fees are calculated for eligible recycling centers. Handling Fee Emergency Regulations are necessary in order to ensure that the cost survey criteria are in place prior to the cost surveys being started in early 2007. |

Assembly Bill 3056 ( Chapter 907, Statutes of 2006) instituted a new Market Development Payment Program that may make a payment to California certified entities that wash and flake or pelletize plastic materials in California. This progam may also make a payment to product manufacturers in Calfornia that manufacture products out of the flake, pellets or other form of plastic produced by the certified entity. |

Proposed Quality Incentive Payment Emergency Regulations Notice

Assembly Bill 3056 (Chapter 907, Statutes of 2006) instituted a new Quality Incentive Payment (QIP) Program, and authorizes expenditures of up to $15 million annually. The QIP Program will provide fiscal incentives to registered curbside programs or other certified entities to improve the quality and marketability empty glass, plastic and aluminum beverage containers collected by registered curbside programs or dropoff or collection programs. |

Emergency regulations may be readopted if permanent regulations are not in effect at the time the emergency regulation expires. |
